SOURCES AND COLLECTION OF PERSONAL INFORMATION

The types of personal information that we collect about you depend on how you interact with us. We have set out below the types of personal information we may collect, or have collected in the preceding twelve months, by the different sources of information listed below:

Information You Provide to Us

We collect information you provide directly to us. For example, we collect personal information directly from you when you create an account, make a purchase, submit or post content through our Services (including product reviews and other user-generated content), communicate with us via third-party platforms, participate in our contests, sweepstakes, or promotions, sign up for marketing communications from us, request customer support, or otherwise communicate with us.

The types of personal information we may collect include:

  • Identifiers and contact details: name, email address, billing and shipping addresses, phone number, and social media handle;

  • Account credentials: username and password for logging into our website;

  • Demographic information: month and day of birth and gender;

  • Lifestyle and preference information: body measurements, sizing, body type, interests, hobbies, shopping habits, lifestyle information, and product preferences;

  • Applicant Information: employment history, education history, other information provided in your CV, and other information required to process your application or employment;

  • Financial information: credit card information and bank account information through our payment processing partners;

  • Transactional Information: product details, purchase price, and the date and location of the transaction;

  • Multimedia content: images, videos, or voice recordings you upload, submit, or otherwise share with us; and

  • Other information you choose to provide in your interactions with us.

  • Inferences: In addition to the information we collect directly from you and your devices, we may develop insights or draw inferences about you by analyzing or combining the data we hold. This helps us better understand and improve our services, tailor content, and provide offerings that are more relevant to you.

Information We Collect Automatically

We automatically collect certain information about your interactions with us or our Services, including:

  • Device, Usage, and Location Information: We collect information about how you access or use our Services, including data about the device and network you use (such as hardware model, operating system version, mobile network, IP address, unique device identifiers, and browser type). We also collect information about your activity on our Services (such as the routes by which you access our Services, access dates and times, pages viewed, links clicked, items placed in your cart, and wish list activity), as well as your interactions with our advertisements and communications. In addition, we may collect geolocation data, including. general location information (e.g., derived from your IP address, WiFi, or Bluetooth connections);

Information We Collect from Other Sources

We may also collect information about you from third-party sources, which helps us supplement, improve, or personalize the information we hold. These sources may include:

  • Marketing partners such as joint marketing or co-branding partners, data cooperatives, and marketing, advertising, and analytics providers;

  • Service providers and vendors such as fraud prevention and security providers, mailing list and fulfillment partners, and shipping carriers; and

  • Social media platforms and similar services when you engage with our content—for example, by liking, following, or sharing our posts on Facebook, Instagram, X , or other platforms.

Additionally, if you create or log into your account associated with our Services through a third-party platform (such as Apple, Facebook, Google, or Instagram), we may receive certain information from that platform consistent with your settings and their authorization procedures. This may include your profile information, profile picture, user ID associated with your third-party account, and any other information the platform makes available to us.

HOW WE USE YOUR PERSONAL INFORMATION

HOW WE DISCLOSE YOUR PERSONAL INFORMATION

  • Service providers and vendors. We disclose personal information to vendors, service providers, contractors, and consultants that need the information to provide services to us. These include partners that assist with web hosting, shipping and delivery, payment processing, financing, fraud prevention, customer service, marketing, advertising, and analytics.

  • Public content. If you submit a product review, post user-generated content, or otherwise interact with our Services in a way that is public, other users of our Services—and, where applicable, other websites where our products are sold—will be able to view this information.

  • Marketing partners. We may disclose personal information to our marketing partners to expand the reach and effectiveness of our marketing campaigns. Depending on where you are located, you may have the right to opt out of these disclosures as explained in the “Your Choices” section below.

  • With your consent. We disclose personal information when you direct us to do so or otherwise provide your consent.

We may also disclose aggregated or de-identified information that cannot reasonably be used to identify you. We maintain, use, and disclose such information only in a de-identified form and will not attempt to re-identify it, except as permitted by law.

CHILDREN’S DATA

Our Services are intended for users 13 and older. If you are under 13, do not use or provide any information on the Services. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that personal information promptly. If you believe we might have any personal information from or about a child under 13, please contact us. If you believe we may have inadvertently collected information from a child or minor, please contact us at the information set out below so we can investigate and address the matter.

YOUR RIGHTS AND CHOICES

Depending on where you are located (e.g., California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia), you may have certain rights regarding your personal information:

Your Right to Know and Right of Data Portability.

You have the right to request that we provide certain information to you about our collection and use of your personal information. You also have the right to request that we provide the specific pieces of personal information we collected about you in a machine readable format.

Your Right to Delete.

You also have the right to request that we delete personal information collected from you subject to certain exceptions. We cannot delete your personal information without removing you from rewards programs or other programs that for which you have signed up or entered.

Your Right to Correct.

If we receive a verifiable request from you to correct inaccurate personal information about you, we will use commercially reasonable efforts to correct such personal information.

Right to Object to Processing.

You have the right to object to our processing of your personal information, under certain conditions, and we may be required to no longer process your personal information. Such right to object may especially apply if we collect and process your personal information through automated decision making, such as profiling, to better understand your interests in our products and Services or for direct marketing.  If you have a right to object and you exercise this right, your personal information will no longer be processed by us for such purposes. Such a right to object may not exist if the processing of your personal information is necessary to take steps prior to entering into a contract or to perform a contract already concluded. 

Right to Withdraw Consent.

Where we rely on your consent to process your personal information, you have the right to withdraw that consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal. 

Right to Opt-Out of the Sale or Sharing of Personal Information.

You have the right to opt out of having your personal information sold, shared, or used for targeted advertising. You may opt out by clicking the “Your Privacy Choices” button at the footer of our website. You may also opt out of sales, sharing, or targeted advertising associated with your email address, or other information we may disclose to our advertising or other partners so they can show you ads that are more relevant to your interests, by visiting this form and submitting the required information.  

You Can Opt-Out Of Receiving Our Marketing Emails.

When you sign up for our newsletter or rewards programs, you will be asked to provide us with an accurate e-mail address through which we may contact you. Such registration through our Services constitutes your express acknowledgment that we may use your e-mail address to communicate with you about product offerings (unless affirmative consent is otherwise required by applicable law). To stop receiving our promotional emails, you may email us at customerservice@gruntstyle.com or follow the instructions in any promotional message you get from us. Even if you opt out of getting marketing messages, we may still contact you through email in response to your questions.

Non-Discrimination.

You have the right to not be discriminated against in pricing and services because you exercise any of your rights described above. 

Exercising Your Rights. 

Please note that many of the above rights are subject to exceptions and limitations, and our responses will vary based on the circumstances of the request and on your location. If you choose to assert any of these rights under applicable law, we will respond in accordance with and within the time-period prescribed by such law.

If you are located in the State of California in the United States, a person authorized to act on your behalf may make a verifiable request related to your personal information.  If you designate an authorized person to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent permission to make a request on your behalf. 

When you submit a request, your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

If we deny your request, you may submit an appeal by contacting us at customerservice@gruntstyle.com. We will review your appeal and respond in accordance with applicable law. If you remain unsatisfied with our response, you may also contact the attorney general’s office in your state of residence to raise any concerns.

TRACKING TECHNOLOGIES 

We Use Common Tracking Technologies.

Like many websites, we use digital tracking technologies such as cookies, pixels, web beacons, and similar technologies (collectively, “Cookies”) to record your preferences, track the use of our sites, and for the related purposes described below. We may also use these technologies to monitor traffic, improve the sites, and make the sites easier to use and more relevant.

Advertising Cookies

Advertising Cookies may be placed by us or third parties to enable third party ad networks to recognize a unique Cookie on your computer or mobile device.  The information that is collected and shared by these types of Cookies may also be linked to the device identifier of the device you are using to allow us to keep track of all the websites you have visited that are associated with the ad network.  This information may be used for the purpose of targeting advertisements on our website and third-party sites based on those interests. 

 

Your browser or device may include “Do Not Track” functionality. Our sites are not built to respond to such Do Not Track signals. That means that even if your browser is set to “Do Not Track,” our information collection and disclosure practices (including the choices that we provide to customers) will continue to operate as described in this Privacy Policy, whether or not a Do Not Track signal is received. Our website is, however, configured to recognize universal opt-out signals, such as Global Privacy Control. 

NOTICE OF FINANCIAL INCENTIVES

We may offer discounts, rewards, or other benefits to customers who sign up to receive our marketing emails or text messages (if you opt in to receive text messages). These offerings may qualify as “financial incentives” or “bona fide loyalty programs” under certain state privacy laws (together, we refer to them as “financial incentives”).

When you participate in a financial incentive, we collect personal information from you such as:

  • Identifiers (e.g., name, email address, phone number);

  • Commercial information (e.g., purchase history); and

  • Inferences drawn from your information (e.g., product preferences and interests).

We may disclose this information to our service providers, contractors, and consultants who perform services on our behalf; to other brands within our corporate family; and to our marketing and advertising partners, including for purposes of targeted advertising and other marketing activities.

We generally do not assign monetary value to personal information or promotional activities in which we engage. To the extent we create overall value from such financial incentives to our business that could be directly or reasonably related to the value of personal information, the method for calculating the value would include: (1) costs related to maintaining the financial incentives, including but not limited to IT infrastructure, delivery of offers, and skilled marketing teams with the appropriate knowledge to enhance personal information; (2) whether the sales generated by the financial incentives exceed the cost to us of offering the financial incentives, including the value of discounts to customer; (3) the value of the insights we are able to create based upon aggregate data; and (4) such other data and/or metrics we may consider relevant to any such calculation. These factors may change over time. 

You may opt into a financial incentive by following the sign-up or participation instructions provided. You may opt out at any time by using the unsubscribe instructions in the applicable program terms, promotional emails, or text messages, or by contacting us at customerservice@gruntstyle.com.

If you request deletion of personal information that is necessary for us to provide a financial incentive (for example, your email address for an email-based discount program), we will be unable to continue providing the associated benefits. Additional terms and conditions may apply, and we will make them available to you at the time you sign up.

HOW WE PROTECT YOUR PERSONAL INFORMATION

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal information from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal information transmitted to, through, using, or in connection with the Services.  The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal information against unauthorized use, disclosure, and access. 

HOW WE RETAIN YOUR PERSONAL INFORMATION

We generally keep the categories of personal information described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. 

CHANGES TO OUR PRIVACY POLICY

We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law. The date the privacy policy was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the “last updated” date and posting the updated policy on the Services. We may email or otherwise communicate reminders about this policy, but you should check our Services periodically to see the current policy and any changes we have made to it.

We may provide links to other websites, services, and applications (e.g., Facebook, Twitter) that are not operated or controlled by us (“Third Party Sites”). These Third Party Sites also may include activity feed, social media buttons and widgets, such as “Like” or “Share This” buttons. This policy does not apply to your use of Third Party Sites. You should review and understand the privacy practices of any Third Party Sites before using them and providing them with your information.
